Welcome to the website of Alma Ola (“Alma Ola”, “we”, “us” or “our”).

These Terms of Use (the “Terms”) govern your access to and use of Alma Ola’s website including all information, goods and services )the “Service”) available on our website at https://almaola.com/ (the “Site”). These Terms apply to all users of the Site, including without limitation, users who are browsers, vendors, resellers, prospective and current customers, merchants and/ or contributors of content (collectively, the “Users”).

PLEASE READ CAREFULLY THE TERMS BECAUSE THEY, ALONG WITH OUR PRIVACY POLICY, CONSTITUTE A BINDING AGREEMENT BETWEEN YOU, THE INDIVIDUAL OR ENTITY ACCESSING OR USING THE SITE IN ANY MANNER AND IN ANY OF ITS CONFIGURATIONS. YOU SIGNIFY YOUR ACCEPTANCE OF THESE TERMS AND YOU AGREE TO BE BOUND BY THEM AND TO COMPLY WITH ALL APPLICABLE LAWS AND REGULATIONS REGARDING YOUR USE OF THE SITE AND YOU ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A BINDING AND ENFORCEABLE LEGAL CONTRACT BETWEEN YOU AND ALMA OLA. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT CONNECT, ACCESS OR USE THE SITE IN ANY MANNER.

We reserve the right, at our sole discretion, to change or modify all or part of these Terms at any time without prior notice. We advise Users to regularly review these Terms for updates. By continuing to use the Site after any changes are made, you accept and agree to those changes. Note that, neither users nor their representatives can make claims or legal actions against Alma Ola, the Site, or its affiliates regarding this matter.

Users must be of legal age in their country or region to use or create an account on the Site. Users under such age must be supervised by a guardian who agrees to these Terms. If you don’t meet these criteria, refrain from using the Site.

Use Restrictions

1. Except as expressly provided herein, you must follow the rules herein and must not permit anyone to break these rules:

• Do any action that may infringe upon the intellectual property rights of Alma Ola, in any form, is prohibited;
• Do not translate, modify, distribute, republish, download, display, copy, or otherwise reproduce the Site in whole or in part and/or transmit the Site in any form or by any means;
• Do not reverse engineer, decompile, disassemble or otherwise attempt to discover or derive the source code, object code, or underlying structure, ideas or algorithms of any part of the Site or any documentation or data related to or provided with the Site;
• Do not defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, including others’ right to privacy, others’ copyrights, and other intellectual property rights;
• Do not assign, license, sublicense, pledge, lease, rent, transfer, publish, distribute, host, sell, market, or otherwise commercially exploit and/or share our rights under these Terms;
• Any commercial or other use of the information and/or other data published on the Site is strictly prohibited;
• Do not create a database by systematically downloading and storing all or any of the content from the Site; You may use the content made available through the Site solely for the purpose and as necessary to enable personal use of the Site;
• Do not create derivative works based upon any or all of the Site or any of its components and/or outputs;
• Do not interfere in any manner or disrupt the functionality of the Site;
• Do not make the Site or materials resulting from the Site available in any manner to any third party for use in the third party’s business operations;
• Do not access or use the Site in order to build or support, and/or assist a third party in building or supporting, products or services similar and/or competitive to those presented or offered at the Site;
• Do not transmit or otherwise make available in connection with the Site any virus, worm, trojan horse, time bomb, web bug, spyware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component;
• Do not use the Site in any manner that could damage, disable, overburden, impair or otherwise interfere with the Site;
• Do not perform any activity that constitutes or encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, foreign law or industry standard, including, without limitation, any applicable laws and regulations;
• Do not use the Site and/or its outputs unlawfully or in any manner not expressly authorized by these Terms;
• Linking to the Site from illegal websites, including gambling sites, pornography and hate sites, is strictly prohibited;
• We reserve the right, at our sole discretion, to terminate your use of the Site without prior notice due to violating any of the restrictions mentioned above or other prohibited uses (collectively the “actions”). Alma Ola’s electronic records, including user activities and details, are considered definitive proof of those actions.

Users agree to indemnify Alma Ola for any damages or costs, direct or indirect, resulting from claims or damages due to violations of the stated usage restrictions, without prejudice to Alma Ola’s rights under these Terms and any applicable law.

Products and Services; Terms of Sale

Alma Ola sells products on the Site for personal use only. Wholesale buying, resale, or any non-personal use is prohibited.

Payment methods; Prices

Subject to these Terms, purchasing and payment will be enabled by credit cards, PayPal or gift vouchers produced by Alma Ola only.

Prices on the Site are in Dollars ($) and include VAT, unless explicitly stated otherwise. Shipping fees are not included, and the final price will be determined during the order completion process.

Please note that prices on the Site might vary from those in Alma Ola’s physical locations or other third-party outlets carrying our products.

We reserve the right to conduct promotions, offer benefits, or discounts under the terms we determine. These might be exclusive to the Site or our physical store, depending on our discretion.

The product selection displayed on the Site and offered for sale is subject to our exclusive discretion. We may update the products, replace them, cease offering them, remove products that are out of stock, add or remove sizes and/or colors, and so forth, all at Alma Ola’s exclusive discretion.

Alma Ola may adjust product prices and shipping rates on the Site without advance notice. The Users are committed to the price presented when completing the order process.

Users will be charged for products and shipping once all necessary approvals, like credit card authorization, are secured for their chosen payment method. No claim by the user regarding this matter, including any arising from it (e.g., in case of order cancellation due to payment failure), will be entertained.

Placing an order.

Users may register for an account, as well as place an order as a one-time purchaser.

Performing a purchase on the Site will be subject to the following cumulative terms:

1. Users must have the legal capacity for binding actions. Use of the Site by those under 18 or needing guardian consent implies they have such permission.
2. Users must possess a valid and active email address.
3. Users with a credit card must have a valid Israeli or international card from a recognized company, with approved transactions. Users can also use our valid gift voucher. We retain the right to decline certain types of credit cards.
4. The requested product(s) must be in stock.
5. Users must provide necessary purchase details: full name, phone, shipping address, email, and payment information (potentially including the initiator’s ID). By sharing their email, they consent to Alma Ola’s communications, including those about orders.
6. Users must submit the details outlined in section 5 and finalize the purchase (the “Order”). Upon receiving approval from the credit card company, Users will receive an email confirmation of the Order, according to the provided details.

Please note that Alma Ola will not be liable for unfulfilled an Order as a result of incorrect or missing details. Users must ensure accuracy. Providing false information or illegal payment methods can lead to legal consequences. We reserve the right to cancel an Order with false or incomplete details.

After order approval, if products are unavailable, Alma Ola will inform the customer within one business day. Customers can select an alternative product or cancel for free. We are not obliged to sell the product(s), and no damage claims are accepted. Processed payments will be refunded or charges reversed.

Delivery and Additional Terms

Processing time for handling an Order is typically 2-4 business days but may be extended due to special occasions such as stock clearance, end-of-season sales or holidays.

Delivery will be arranged by a courier company chosen at our sole discretion. Courier’s terms and conditions will apply to any Order through the Site and will be binding on the Users.

Orders will be delivered by a courier to the address given during ordering. Changing the address afterward may delay delivery.

Estimated delivery is within 3-5 business days from order approval (excluding the order day itself, Fridays, Saturdays, holidays and special occasions). Delivery times may vary based on the courier’s terms.

Shipping is free for purchases over US $120.

Shipping fee applies with respect to purchases up to US $120 (including VAT) per order. This fee, added to the product price, will be shown before payment on the Site.

Shipping fees are combined with product payment and aren’t refundable unless an Order is canceled prior to its pick-up by the courier or as per the cancellation policy at https://almaola.com/cancel-order-page/.

Alma Ola is not responsible for delays or non-delivery due to customer contact issues or incorrect details. If an order has not been collected or received due to the customer’s requests it was left in a specific place, the customer bears full responsibility, including for theft or damage.

For delays due to force majeure and/or unforeseen events like strikes or natural disasters, Alma Ola is not liable but will try to notify customers of any known delays using the provided contact details.

PLEASE NOTE: Alma Ola will not bear any tax or payments mandated by the destination country’s laws or regulations.  Alma Ola will not be held responsible in the event of non-arrival of the Order as a result of non-payment of tax or other payment as mentioned and the Order will be considered as having reached its destination.

Return  of Products

Web purchases can be returned within 14 days of receipt, given original packaging, unused condition, all labels attached, hygienic sticker intact and presented with the original purchase receipt (“Proof of Purchase“) only. All in accordance with the Consumer Protection Law 5741-1981 of the State of Israel (the “Law”) and these terms. Exceptions: non-website purchases and items legally deemed non-cancellable.

Returns are accepted by registered mail to our address below, along with the Proof of Purchase and the returns form provided with the Order, filled out according to our instructions.

Alma Ola will not be liable for mailed return damages/losses. Handling the Order returned is subject to the Israel Post handling income mail. Alma Ola shall not have any control or responsibility in this matter.

Return processing takes up to 4 business days post-receipt at Alma Ola.

Products made and/or specially tailored for the customer are not eligible for returns.

Promotions/discount returns adhere to promotional terms and legal standards.

After 30 days post-order, return/exchange requests are handled at Alma Ola’s sole discretion. For queries, contact info@almaola.com.

PLEASE NOTE: The Customer will cover any shipping fees and extra charges for exchanges or returns.
Alma Ola will not be held responsible in the event of non-arrival of the Order as a result of non-payment of tax or other payment as mentioned and the Order will be considered as having reached its destination.

Credit

If a customer cancels a transaction and isn’t eligible for a refund per regulations or chooses not to get one, Alma Ola might offer a credit voucher for online purchase only. This voucher, sent to the customer’s email given at purchase, remains valid for two years from its delivery date.

Gift cards

Customers can purchase gift cards on our Site for product purchases.
Their use, purchase, or cancellation terms are subject to these Terms.

Ordered gift cards are emailed to the provided address during purchase.

Gift cards are valid for two (2) years from the delivery date to the customer’s email provided by it during the Site registration.

Gift card holders, even non-original purchasers, must follow these Terms and are subject thereto. The Gift card value equates to its purchase price (minus delivery fees). They can’t be cashed out, and no credits are given for unused Vouchers.

Alma Ola is not accountable for lost, stolen, or misused Gift cards, or if unused within its validity.

These Gift cards are not considered debit cards per the Debit Card Law, 1986.

Content

The Site offers information and services about Alma Ola’s offerings at our sole discretion. It may also provide future details like upcoming products.

We reserve the right to modify the Site’s content, design, services, and product offerings without notice. Users cannot hold Alma Ola accountable for these changes or any related issues.

Additionally, the Site might feature promotional content.

External links; Advertisements

Alma Ola may feature third-party ads or offers on the Site. Alma Ola is not responsible for these ads or external links. Information on linked sites adheres to their respective terms and privacy policies. Alma Ola does not endorse or associate with these sites and can add or remove links at its discretion.

Intellectual Property

All copyrights and intellectual property in the Site, its content, design, services, and products displayed, including, but not limited to, trademarks, industrial designs, algorithms, images, texts, videos, audio files, graphics files, and any other content, methods, patents, trade secrets, databases, and other proprietary rights, whether registered or unregistered (“Protected Material“), are the exclusive property of Alma Ola (or other third parties, such as business partners who have granted Alma Ola permission to use them). No use of the Protected Material, whether independently or in collaboration with a third party, in any way or manner, is allowed without explicit prior written permission from Alma Ola. It is clarified that publishing and/or including content on the Site or the user’s use of the Site does not grant the user any rights in the Protected Material.

Alma Ola is entitled to use any content uploaded by the user to the Site for any purpose, including social media and mentioning Alma Ola’s name or tagging it, without notifying the user. The user will have no claim, demand, or lawsuit against Alma Ola or anyone acting on its behalf regarding such use. A user who does not wish to be subject to such use is encouraged to contact Alma Ola’s customer service to avoid it.

Limitation of Liability

The use of the Site is solely at the user’s responsibility. The Site and its content are provided to the user “AS IS” and “AS AVAILABLE”.” Alma Ola endeavours to ensure that the content presented on the Site is complete and accurate; however, inaccuracies or errors may occur. Product images displayed on the Site are for illustrative purposes only, and differences between the appearance, features, and specifications of the products as presented on the Site and those received may occur, due to factors beyond Alma Ola’s control. It is clarified that Alma Ola and anyone acting on its behalf is not responsible for any inaccuracies or differences as mentioned, any malfunction and/or failure of the Site and/or its use and/or the internet and/or communication services, and any direct, indirect, consequential, or special damages, and/or loss and/or expense incurred by the user or any third party as a result of the user’s actions and/or negligence and/or responsibility, viewing the Site and/or making a purchase transaction on the Site, or any other use or non-use in accordance with these Terms. The cause of action shall be what it is. Alma Ola is not responsible for any damage, including due to viruses and/or software malfunctions of any kind, to the user’s computer equipment or any other property that may result from accessing, browsing, or using the Site, and in any case, Alma Ola shall not be liable for any expense or payment exceeding the value of the purchased product. Notwithstanding the above, Alma Ola is entitled to discontinue the operation of the Site at any time (in full or in part), at its exclusive discretion, without prejudice, and including, without being obligated to provide the user with prior notice of the cessation of the operation.

Privacy; Data Security

We prioritize user privacy. Our privacy practices for this Site can be found at https://almaola.com/privacypolicy/ (“Privacy Policy“), which forms a core part of these Terms. By using the Site, Users consent to our Privacy Policy. The Privacy Policy covers personal details shared for account creation, joining a customer club, or approving the receipt of direct mails.

Miscellaneous

The headings in these Terms are not binding or exhaustive and are intended for convenience only.

In the event of a contradiction and/or inconsistency between the provisions of these Termsand any other provisions regarding and/or in connection with the Site, the provisions of these Terms shall prevail.

Alma Ola may assign its rights according to these Terms of use to any third party as it deems appropriate and without any obligation on the part of Alma Ola to publish the aforementioned assignment on the Site.

The law that applies to and in connection with these Terms of use and the use of the Site is Israeli law only (whether the Site is used in Israel or abroad). The exclusive jurisdiction in connection with the terms of use and the use of the Site is granted to the competent court in Tel Aviv Jaffa only.

Should it be determined that any part of the Terms of use is invalid or unenforceable, then the clauses that were invalidated or decided to be unenforceable will be considered replaced by valid and enforceable clauses, the content of which corresponds as closely as possible to the intent of the original clauses, and the other clauses of the terms of use will remain in effect.
